As you have already heard, USCIS has issued a policy guideline for requesting employment authorization under compelling circumstances. To read more about the guideline, please visit this USCIS website. This page lists the requirements to file an Employment Authorization Document (EAD) based on compelling circumstances, as well as reasons which are considered compelling circumstances.
This may sound like a great option, however, we would like to bring a few points to your attention regarding applying for an EAD based on compelling circumstances:
We advise our clients to keep these points in mind before making a decision. We cannot give legal advice on this blog, but generally speaking, there are really limited circumstances in which this type of EAD would be appropriate or helpful. For information about the process, please review this USCIS website. If you are a current client of Sumner Immigration Law and you are considering this EAD as an option, please consult with us before making a decision.
As always, the above information is for educational purposes only and is not legal advice. Please speak with a qualified immigration lawyer before taking action.
