National Interest Waiver Criteria

To qualify for the National Interest Waiver category (EB-2), the beneficiary must show:

  1. The beneficiary seeks employment in an area of substantial intrinsic national merit;
  2. The benefit would be national in scope; and
  3. The national interest would be adversely affected if a labor certification were required.
