To qualify for the National Interest Waiver category (EB-2 visa), the beneficiary must show:

1. That their proposed endeavor is of “substantial merit and national importance”;
2. That they are “well-positioned” to execute their proposed endeavor; and
3. That, on balance, it would be in the national interest to waive the job offer and PERM certification requirements.

In addition, the foreign national applying for the National Interest Waiver must have an advanced degree or exceptional ability.
